Terms of Service
Terms of service for HireSysAdmin.com — scope, billing, responsibilities and limitations for on-demand and recurring system administration services.
Scope of Work
All system administration work performed by HireSysAdmin is limited to the scope agreed upon before commencement. Work outside the agreed scope requires separate confirmation and may be quoted separately. We perform only the tasks explicitly requested and confirmed with the client.
Client Authorization
By requesting work, the client confirms they are authorized to request system administration services on the systems and infrastructure in question. HireSysAdmin is not responsible for verifying the client’s authority over third-party systems.
Hourly Billing
Standard on-demand work is billed at the agreed hourly rate, with a minimum engagement of 1 hour. Time is tracked in 15-minute increments after the first hour. The rate, estimated duration and scope are confirmed before work begins.
Emergency Billing
Emergency and urgent work is billed at the emergency hourly rate, with a minimum intervention fee. Emergency rates are higher than standard rates and reflect priority handling and out-of-hours availability. The minimum fee and rate are communicated before work starts.
Access and Credentials
The client is responsible for providing accurate and complete access credentials (SSH, panel, VPN, RDP, etc.) as required for the agreed work. Delays caused by insufficient or incorrect access are not the responsibility of HireSysAdmin.
Backups
The client is responsible for maintaining current backups of all systems and data before any work begins. While we take reasonable care during all interventions, we strongly recommend verified backups be in place before changes are made. HireSysAdmin is not responsible for data loss resulting from pre-existing backup failures.
No Absolute Guarantee
System administration work addresses known issues and configurations at the time of the engagement. No intervention can guarantee absolute uptime, security or prevention of future issues. New problems may emerge after work is completed, and the state of any system changes over time.
Excluded Services
Unless explicitly included in the agreed scope, the following are not part of standard sysadmin engagements:
- Software development or custom application coding
- Legal, regulatory or compliance audits (GDPR, PCI-DSS, etc.)
- Hardware procurement or physical datacenter work
- Ongoing 24/7 monitoring (available as a separate retainer add-on)
- Managed hosting or infrastructure-as-a-service
Confidentiality
All information accessed during service engagements — including system configurations, credentials, logs and business data — is treated as confidential. We do not share client data with third parties except where strictly necessary to deliver the service or where required by law.
Limitation of Liability
Our total liability in connection with any engagement is limited to the fee paid for that specific engagement. We are not liable for indirect, incidental or consequential damages, including but not limited to lost revenue, data loss or business interruption.
Payment Terms
- Standard work is invoiced upon completion or as agreed in the engagement terms
- Emergency work may require advance payment or immediate invoicing
- Monthly retainers are invoiced in advance at the start of each billing period
- Payment is due within 14 days of the invoice date
- All prices are exclusive of VAT, which will be applied where required by law
Cancellation
- On-demand engagements may be cancelled before work begins at no charge
- Work already performed is billed at the agreed rate
- Monthly retainers may be cancelled with 30 days written notice; unused hours within the current billing period are not refunded
- Emergency engagements are subject to the minimum intervention fee once work has commenced
Governing Law
These terms are governed by the laws of Romania and applicable European Union regulations. Any disputes arising from these terms or our engagements shall be subject to the jurisdiction of the competent courts in Romania.
